Terms of service
1. Contracting entity
These Terms of Service govern access to and use of Lymwave. Lymwave is operated by BitFoundry OÜ, an Estonian private limited company with registry code 17352996.
By accessing or using Lymwave, you agree to these Terms. If you do not agree, do not use the service.
2. Service description
Lymwave provides AI-assisted content marketing workflows for planning, drafting, optimizing, publishing, and monitoring content for SEO, AEO, and GEO. The service may include content strategy generation, article drafts, SEO/AEO/GEO review, publishing integrations, visibility monitoring, reporting, and related workflow automation.
Lymwave is an operational and informational tool. It does not provide legal, financial, tax, or professional marketing guarantees. You remain responsible for reviewing outputs, approving public content, and deciding whether generated recommendations are appropriate for your business.
3. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into binding agreements to use Lymwave. You are responsible for providing accurate account information, keeping credentials secure, and all activity that occurs under your account or workspace.
If you use Lymwave for an organization, you represent that you have authority to bind that organization to these Terms.
4. Acceptable use
You agree to use Lymwave only for lawful purposes and in a way that does not harm the service, other users, or third parties.
You must not:
- submit content, prompts, credentials, repositories, websites, or customer data that you are not authorized to process;
- use Lymwave to generate unlawful, deceptive, infringing, abusive, or harmful content;
- bypass plan limits, rate limits, access controls, or technical safeguards;
- reverse engineer, scrape, overload, interfere with, or attempt to gain unauthorized access to the service;
- use Lymwave in violation of applicable export control, sanctions, privacy, intellectual property, or platform rules.
We may suspend or restrict access if we believe your use violates these Terms, creates security risk, causes service disruption, or may expose BitFoundry OÜ, Lymwave, users, or third parties to harm.
5. Customer content and permissions
You retain ownership of content, prompts, websites, repository metadata, integrations, drafts, reports, and other materials you submit to Lymwave. You grant BitFoundry OÜ a limited, non-exclusive license to process that material only as needed to provide, secure, support, and improve the service.
You are responsible for ensuring that you have the rights and permissions needed to connect websites, repositories, CMS accounts, analytics tools, or publishing destinations to Lymwave.
Customer content, repositories, drafts, and reports are not used to train shared AI systems.
6. AI outputs and human review
Lymwave may generate drafts, recommendations, reports, summaries, metadata, schema suggestions, visibility findings, and other outputs using automated systems. Outputs may be incomplete, inaccurate, duplicative, outdated, or inappropriate for your business unless reviewed.
You are responsible for human review before publishing or relying on any output. You should verify facts, claims, links, metadata, compliance-sensitive statements, competitive comparisons, and integration actions before use.
7. Billing and plans
Paid plans are billed in advance on a recurring basis unless cancelled. Payments may be processed by Stripe or another payment provider shown at checkout. Fees are non-refundable except where required by law or expressly stated in a written agreement.
Plan limits, included features, trials, usage allowances, and pricing may vary by plan. Plans described as unlimited remain subject to fair and reasonable use consistent with normal content operations and development workflows.
You may cancel your subscription according to the billing flow available in the product. Cancellation stops future renewals but does not automatically refund past charges.
8. Intellectual property
The Lymwave service, software, workflows, interface, branding, detection logic, templates, documentation, and underlying technology are owned by BitFoundry OÜ or its licensors and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms, you may use Lymwave outputs for your internal business and publishing workflows. This permission does not transfer ownership of the Lymwave platform, software, or proprietary methods.
9. Integrations and third-party services
Lymwave may connect with third-party services such as CMS platforms, GitHub, analytics tools, payment providers, email providers, AI providers, or hosting services. Your use of those services is governed by their own terms and policies.
We are not responsible for third-party service availability, changes, data handling, or errors. You are responsible for maintaining access, permissions, credentials, and configuration for services you connect.
10. Availability and disclaimer
Lymwave is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free results, search ranking improvements, AI citation placement, traffic growth, revenue outcomes, or compatibility with every third-party service.
To the maximum extent permitted by law, BitFoundry OÜ disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, BitFoundry OÜ will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or lost-profit damages, or for loss of data, business, goodwill, rankings, traffic, or revenue.
To the maximum extent permitted by law, BitFoundry OÜ's aggregate liability for claims related to Lymwave is limited to the amount you paid for the service in the twelve months before the event giving rise to the claim.
12. Termination
You may stop using Lymwave or cancel your subscription at any time. We may suspend or terminate access for non-payment, abuse, security risk, legal requirements, or violation of these Terms.
After termination, we may retain certain records as needed for billing, security, legal compliance, dispute resolution, and legitimate business operations.
13. Governing law and disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the courts of Estonia, unless applicable law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as posting the updated Terms on this page or notifying account owners through the service.
Continued use of Lymwave after updated Terms become effective means you accept the updated Terms.
